Hitachi ID MAKES NO EXPRESS OR IMPLIED WARRANTIES, CONDITIONS OR REPRESENTATIONS WHATSOEVER, AND SPECIFICALLY DISCLAIMS THE SAME INCLUDING WITHOUT LIMITATION, ANY WARRANTIES, REPRESENTATIONS OR CONDITIONS OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE INCLUDING THOSE IMPLIED BY STATUTE. THE DOCUMENT MAY CONTAIN ERRORS. Hitachi ID ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY SUCH ERRORS.

Limited liability

IN NO EVENT SHALL Hitachi ID BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE DOCUMENT HOWEVER ARISING, INCLUDING THROUGH NEGLIGENCE, EVEN IF Hitachi ID HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL OTHER CIRCUMSTANCES Hitachi ID'S TOTAL AGGREGATE LIABILITY TO YOU OR ANY THIRD PARTY, HOWEVER ARISING, SHALL BE LIMITED TO $10.00 (CDN).

INDEMNITY

You agree to hold Hitachi ID, its employees, officers, directors and agents harmless from any and all claims or demands, including reasonable attorney fees, made by anyone due to or arising from your use of the Document or your violation of these Terms of Use.

No agency

Any entity which places the Document at its website or makes copies of The Document subject to these Terms of Use and Hitachi ID are independent entities and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship exists between those parties, unless such relationship has been established with no connection to The Document or the Terms of Use.

No waiver

Hitachi ID's failure to insist upon or enforce strict compliance with any provision of these Terms of Use shall not be construed as a waiver of any provision or right of the same or different type in the future.

Entire agreement

The terms and conditions set out in these Terms of Use constitute the entire terms and conditions with respect to the use of the Documents and the relationship between you and Hitachi ID. No representative of Hitachi ID is authorized to amend the terms of these Terms of Use. Amendments shall only be effective as provided in these Terms of Use.

Termination

Notwithstanding the termination of these Terms of Use for any reason, the provisions of these Terms of Use relating to intellectual property, warranty disclaimer, limited liability, indemnity and governing law shall survive such termination.

Governing law

These Terms of Use, the relationship between you and Hitachi ID and your use of the Document and the resolution of any dispute arising between the parties shall be governed and construed in accordance with the laws of the Province of Alberta and those of Canada applicable therein, without reference to their conflicts of laws. You agree that any legal action or proceeding between you and Hitachi ID which in any way concerns these Terms of Use or the use of the Document shall be brought exclusively in the courts of Alberta. Notwithstanding the foregoing, either party may apply to any court of competent jurisdiction to obtain injunctive relief. Hitachi ID is headquartered in Alberta.

Severability

If any provision of these Terms of Use is held to be invalid or unenforceable, such provision shall be severed from these Terms of Use and the remaining provisions shall remain in full force and effect.

Headings are for reference purposes only and shall not be used in the interpretation of these Terms of Use.
